Terms of Service

These Terms govern your use of IzzyOS, operated by IzzyOS LLC (“we,” “us”). By creating an account or using the Service, you agree to these Terms.

1. The Service

IzzyOS provides an AI Chief of Operations product (“Hire Kai”) and the underlying platform (IzzyOS) that runs marketing, sales, content, follow-up, and support workflows for service businesses. The Service includes a campaign builder, AI agent (Kai), funnel pages, email and SMS automations, voice agents, a content engine, and an integrated inbox.

2. Pricing and billing

• Hire Kai: $997/month OR 10% of attributed revenue, whichever is higher. Billed monthly. No setup fee.
• Migration tier: $25,000+ by application, for established teams that need a managed cutover.
• Attributed revenue means sales generated through funnels Kai built, bookings Kai made, and payments collected through IzzyOS funnel checkouts. We do not take a percentage of revenue from sources Kai did not touch.
• Payment processing is handled by Stripe. By subscribing you agree to Stripe’s terms.
• Failed payments may result in suspension of the Service after a reasonable cure period.
• Pricing for any new product (e.g., a future reseller program) will be communicated separately and require explicit acceptance.

3. Cancellation

You may cancel at any time from your account settings or by emailing support@izzyos.com. Cancellation takes effect at the end of the current billing period. You can export your data via the account settings; we do not retain your customer list, content, or domain configuration after deletion.

4. Data ownership

Your data is yours. Your customer list, content, brand assets, domain configurations, and any other information you provide remain your property. We license rights only to the extent needed to operate the Service for you. On cancellation, you can export everything in standard formats.

5. SMS and voice communications

By providing a phone number — your own, or one collected from a lead through your IzzyOS funnel — you (or the lead) consent to receive SMS and voice communications from IzzyOS as described in our Privacy Policy. Standard message and data rates may apply. Reply STOP to any message to opt out, HELP for support. Voice calls may be recorded for quality.

You agree that any phone numbers you upload, import, or capture through your funnels were obtained with valid consent. You are responsible for honoring opt-out requests for leads collected through your campaigns; the Service provides tools to do so.

6. Acceptable use

• No spam, unsolicited messaging, or violation of TCPA/CAN-SPAM.
• No illegal, deceptive, or fraudulent business activity.
• No content that infringes third-party rights (copyright, trademark, privacy).
• No abuse or harassment of customers, leads, or our team.
• No reverse-engineering, scraping, or unauthorized access of the Service.

We reserve the right to suspend or terminate accounts violating these rules.

7. AI-generated output

The Service uses AI (including models from Anthropic and others) to generate content, voice scripts, emails, and other outputs on your behalf. You are responsible for reviewing AI-generated content before it goes to your customers. We do not guarantee that AI output is accurate, appropriate, or free of error. Set the trust level appropriate to your business in account settings.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance windows, third-party outages (Twilio, Stripe, Supabase, model providers), and unforeseen issues may cause temporary downtime. We will work in good faith to restore service quickly.

9. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, IzzyOS LLC’s total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

10. Indemnification

You agree to indemnify and hold harmless IzzyOS LLC from claims arising out of (a) your use of the Service in violation of these Terms or applicable law, (b) content you provide or generate through the Service, or (c) leads or customers you communicate with via the Service.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware. Disputes will be resolved in the state or federal courts located in Delaware. The prevailing party is entitled to reasonable attorneys’ fees.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance.
